ECJ decision on truck toll

On 28 October 2020, the ECJ decided, regarding EU Directive 1999/62/EC in the version valid from 10 June 2006 to 14 October 2011 and upon request by the Higher Administrative Court for the city of Münster, that in the 2007 report on transport costs, the costs for traffic police should not have been included when collecting the truck toll. Whether and to what extent other road users subject to toll outside of the period in dispute have claims to be reimbursed with regard to the police costs was not clarified by the ECJ judgement.

Also, Toll Collect is currently receiving a very high volume of queries from customers in writing and by telephone regarding possible reimbursement claims. In order to avoid unnecessary wait times for our customer services, we recommend keeping the following information in mind.

Toll Collect makes billing documents available for all registered customers for download for a period of 24 months from the customer portal, as previously. These include the known monthly toll statements (Customer Portal > Invoicing > Invoicing documents > Select time period > Display documents).

Our customer portal is available in 14 languages. Customers whose portal access has not yet been activated can request the activation code for their initial log-on from Toll Collect customer service.

We ask you to note that any claims for reimbursement arising from the ECJ decision must be made in writing to the Federal Office for Goods Transport (BAG). Claims for reimbursement that have been submitted to Toll Collect cannot be forwarded to the BAG.
